Busted cop sues to get job back

NEW YORK, Dec. 5 (UPI) -- A New York police officer is suing to get back his job, which he lost after his wife allegedly spiced up his meatballs with marijuana.

In papers filed in Manhattan Supreme Court, Anthony Chiofalo called Police Commissioner Ray Kelly's decision to fire him "arbitrary, capricious, unreasonable and unconstitutional," The New York Post reported Tuesday.

Chiofalo, a 22-year veteran, was on the elite Joint Terrorist Task Force when he failed a random drug test in 2005.

The suit said he thought the positive result was madness since he didn't smoke reefer. His wife, however, smoked marijuana to ease her back pain.

During the investigation, his wife admitted to loading his meatballs twice with about six joints' worth of marijuana. She said she spiked his dinner twice because she was upset with Chiofalo not retiring after serving 20 years -- something he said he would do.
