NEW YORK, June 16 (UPI) -- A mastiff dog will be getting out of a New York City pound in one piece after a judge ordered the animal released without the mandatory neutering.

Brooklyn Supreme Court Judge Arthur Schack ruled that Spartacus be released to his owner, who had refused to agree to the sterilization.

Spartacus ran away in Queens last month after thieves broke into his owner's truck. Owner Pete Georgoutsos praised Friday's ruling, but the New York Daily News said the city plans to appeal and will keep Spartacus locked up.
