MARENGO, Ill., Dec. 5 (UPI) -- A teenager who admitted he was on his way to festoon a house with toilet paper was shot by another homeowner in a Chicago suburb when he cut across a yard.

Lawyer Kevin O'Reilly told the Chicago Tribune that Patrick K. Gaughan, 18, did not know Jerry Sweat, the man who shot him on his property in Marengo. He described the toilet paper raid planned by Gaughan and a friend as "what high school kids do."

"Should they get shot for it? No," O'Reilly added.

The local authorities apparently agree. Sweat has been charged with aggravated battery with a firearm and reckless discharge of a firearm.

"Even if they were on the property to do something inappropriate, you cannot use that kind of deadly force to defend your property," McHenry County State's Attorney Lou Bianchi told the newspaper.

Sweat told police that he ordered the teenagers to stop and opened fire with a .22-caliber rifle when they refused. His mother told the newspaper that the area has had violent crimes.
