Barney's evil twin deemed legal

LOS ANGELES, Nov. 29 (UPI) -- Texas-based Lyons Partnership must accept the fact their purple dinosaur Barney has a legal evil twin.

Lyons has battled New York musicologist Stuart Frankel since 2002 over the children's toy synonymous with the word "love." Frankel created a parody, giving Barney horns, wolf-like red teeth and a red pentagram over the number 666 on his chest. A red substance that may be blood drips from his fingers.

Frankel's parody of the friendly dinosaur lives at dustyfeet.com/evil/enemy.html, a Web site offering links with titles like "The Jihad to Destroy Barney."

The Electronic Frontier Foundation came to Frankel's defense, citing a legal ruling that permits the use of copyrighted work for parody as long as the use is non-commercial.

EFF told the Los Angeles Times Lyons has filed more than 77 suits since 1998 over intellectual property rights. Lyons settled with Frankel out of court, agreeing to pay the satirist $5,000 and promising to end legal threats.

The paper says neither Lyons nor its attorney returned calls when comments were solicited. Barney isn't talking either.
