AUSTIN, Texas, July 24 (UPI) -- An Austin, Texas, nightclub has been accused of violating a law that prohibits adult businesses from operating within 1,000 feet of a park or school.

The club, called La Bare, was due in court Monday after local authorities said the male dancers qualify the establishment as an adult business, the Austin-American Statesman reported. La Bare is closer than 1,000 feet to the Texas School for the Deaf and the Town Lake hike-and-bike trail, authorities said.

Kevin Cox, the club's co-owner, who faces three misdemeanor charges of operating the business illegally, said the club should not be classified as adult entertainment.

"I have a guy who wears shorts," he said. "He could perform outside. He could run down Congress Avenue with what he has on."

Greg Guernsey, the director of neighborhood planning and zoning, said the ordinance is aimed at keeping adult businesses separated from homes, schools, and churches.

"There are limits on certain uses that come out of decisions by the whole community," Guernsey said.
