DETROIT, May 17 (UPI) -- Talking on a cell phone while driving is technically banned in Detroit but Motor City motorists won't be ticketed for talking -- at least for a while.

Mayor Kwame Kilpatrick Wednesday let the cell phone ban ordinance passed by the City Council stay on his desk and a spokesman said the law would not be enforced right now, pending changes.

"There will be no tickets issued for it," a mayoral spokesman told the Detroit Free Press.

The ban passed earlier this month prohibits use of a cell phone handset by the driver of a moving vehicle, but Kilpatrick believes the law should only be enforced if the driver has committed a moving violation. Hands-free headsets are permitted.

A first violation carries a $100 fine.
