Lawyers split hairs over toll road lease

SOUTH BEND, Ind., May 12 (UPI) -- Lawyers in a South Bend courtroom argued legal points as fine as grammar and punctuation in a bill to lease the Indiana Toll Road for $3.8 billion.

Opponents of the 75-year deal -- negotiated with a Spanish-Australian consortium that manages private roads around the world -- say the position of a semi-colon and a preposition changed the meaning of the document. Supporters of Gov. Mitch Daniels say the leasing deal is a boon to the state and will finance new roads and road repairs.

The controversial deal is scheduled to close on June 30. Meanwhile, lawyers for both sides will be back in St. Joseph Superior Court Monday arguing about grammar, the South Bend (Ind.) Tribune reported.

Foes say the lease signed by the Indiana Finance Authority violates the state constitution and have asked the judge to invalidate the toll road deal.
