Supreme Court to settle N.J.-Del. battle

TRENTON, N.J., July 28 (UPI) -- New Jersey has asked the U.S. Supreme Court to settle a border dispute with Delaware over a liquefied natural gas terminal on the Delaware River.

Delaware argues that BP's plan for the facility in Logan Township includes a 1,900-foot-long pier that would extend into its territory. New Jersey contends that a 1905 agreement gives each state the right to decide on development on its river shores.

"My counterpart in Delaware has rejected our efforts to settle this amicably," acting Gov. Richard J. Codey told the Philadelphia Inquirer. "The plain fact is that the State of Delaware does not have jurisdiction over any projects on New Jersey's shoreline. Delaware has never controlled development on our shore, and will not start doing so now."

Delaware has vetoed other development projects in New Jersey, but the BP terminal is the most contentious. Delaware argues the terminal would be a tempting target for terrorists.
