Courts toss broken penis lawsuit

BOSTON, May 18 (UPI) -- An appeals court has ruled a Boston man cannot collect damages from a former girlfriend for breaking his penis during creative sex.

The ruling stemmed from a 1994 incident where a man the courts identified as "John Doe" fractured his penis during intercourse with a woman the courts called "Mary Moe," the Boston Herald reported Tuesday. The couple's names were withheld to protect their identity.

Doe said he has suffered sexual dysfunction since the incident and sued Moe for negligent sexual intercourse.

In 2001, a Massachusetts Superior Court judge dismissed the suit.

Monday's ruling by the Appeals Court upheld that decision. The court said Doe cannot sue Moe for negligence because they were engaged in consensual sex.


German woman disputes she is dead

HANOVER, Germany, May 18 (UPI) -- A German woman was troubled to discover the reason she was not receiving her pension check was because authorities believed she had died.

Martha Kruse, 82, who asked her pension fund officials why she hadn't received her April and May pension checks, said she wasn't prepared for the answer, the Duetsche Welle reported Tuesday.

"Don't get upset, but you died on Jan. 28," an employee at the Bundesknappschaft fund told her, who added she should send back any checks she had received since then.

After Kruse disputed the bureaucracy's conclusion that she was dead, the fund official asked she produce a "life certificate," from a municipal office that costs $6.

"When someone makes a mistake like that, they could at least offer a bouquet of flowers," Kruse said.


Female orgasm, 'only for fun'

INDIANAPOLIS, May 18 (UPI) -- An Indiana philosopher of science and professor of biology says the female orgasm has no evolutionary function at all.

In her book "The Case of the Female Orgasm: Bias in the Science of Evolution," Dr. Elisabeth Lloyd of Indiana University finds all 20 leading theories on female orgasm as wanting, the San Francisco Chronicle reported Tuesday.

Lloyd says scientists have long insisted on finding an evolutionary function for female orgasms, either because they think women's sexuality must exactly parallel that of men, or because they belive all traits have to be "adaptations" -- that is, serve an evolutionary function.

But she argues female orgasm "is for fun" because "without a link to fertility or reproduction, orgasm cannot be an adaptation."
