State Supreme Court Justice Debra James threw the matter out Friday after the plaintiff failed to rewrite the petition as ordered.

The New York Daily News said Saturday that neighbor Burton Sultan complained that Connery blasted loud music in his Upper East Side apartment and even carried out a poor renovation job that invited rats.

The newspaper said the lawsuit labeled the 76-year-old Connery as a "rude, foul-mouthed, fat old man," which apparently led James to order a more dignified filing from Sultan.
