Barr unit Pliva hit with $8M patent ruling

U.S. generic drug firm Barr said Friday its Croation unit Pliva has been ordered to pay $8 million in patent damages related to arithromycin.

WOODCLIFF LAKE, N.J., June 1 (UPI) -- U.S. generic drug firm Barr said Friday its Croation unit Pliva has been ordered to pay $8 million in patent damages related to azithromycin.

The company said Croatia's Zagreb-based Commercial Court ordered Pliva to pay damages of $7 million plus accrued interest --for a total of $8 million --to individual inventors of a process for manufacturing the antibiotic.

At the center of the case, filed in August 2001, is the "Procedure for obtaining azithromycin dehydrate from azithromycin monohydrate," a method that is protected by Croatian patent number P921491 B1, Barr said.

However, Barr noted in a statement issued Friday that it "believes it has strong grounds for an appeal of the decision."
