Court reinstates injunction against Abbott

GENT, Belgium, March 9 (UPI) -- Innogenetics said Friday a U.S. federal court reinstated a permanent injunction against Abbott for infringing its hepatitis C patent.

Abbott had appealed a ruling that granted Innogenetics' request for a permanent injunction against the company, blocking Abbot from further sales or use of products that infringe on Innogenetics' method for genotyping the hepatitis C virus.

But the U.S. Court of Appeals for the Federal Circuit denied Abbott's appeal and reinstated the permanent injunction.

"Yesterday's decision marks a positive first step in the appeal process and reinforces our belief that we will prevail in the court of appeals, just as we did at trial," said Frank Morich, Innogenetics' chief executive officer.
