CLEVELAND, Aug. 31 (UPI) -- A Cleveland bus driver has formally filed assault charges against Matthew Fox, alleging the actor punched her repeatedly when she refused to let him board.
UsMagazine.com reported Heather Bormann, 29, officially filed the complaint Tuesday regarding the alleged early Sunday incident.
Fox was briefly taken into police custody after Bormann said he appeared drunk and attacked her when she blocked his entrance to the private party bus.
The driver told police the former "Lost" and "Party of Five" star was trying to get a ride from a nightclub to his hotel, but became aggressive when she refused.
Bormann also said she punched Fox back in self defense.
The actor was later released by police to a friend, who took him back to his hotel by taxi.
Prosecutors told CNN they have photos of numerous bruises on Bormann's arms and legs.
"He smelled like a liquor cabinet, like a bar," Bormann told Cleveland.com. "I told him: 'Sorry, buddy, this is a private party. You get off my vehicle.' I told him three times."
UsMagazine.com said Fox's publicist hasn't issued a statement regarding the charges.
The actor is in Cleveland working on the film "I, Alex Cross."
