LOS ANGELES, Dec. 8 (UPI) -- Convicted U.S. tax evader Wesley Snipes's legal team filed an emergency motion Wednesday for a new trial, alleging juror misconduct, court records show.
The film star has been ordered to begin his three-year prison sentence in Pennsylvania Thursday.
TMZ said Snipes's lawyers filed the emergency motion after the actor appeared on CNN's "Larry King Live" Tuesday night.
During the show, King read a statement from a member of the jury that convicted Snipes which said: "There was one juror that had said they knew Mr. Snipes was guilty right when they first saw him during the jury selection."
It was unclear Wednesday whether the judge overseeing the case would grant the request for a new trial based on what Snipes and his attorneys are calling new evidence, TMZ said.
The actor was convicted in 2008 of failure to file tax returns and pay federal income taxes. His conviction was upheld by an appellate court in July and he was told this month he had to surrender to authorities Thursday to begin his prison sentence.
Snipes, 48, starred in the "Blade" trilogy, "White Men Can't Jump," "U.S. Marshals" and "To Wong Foo, Thanks for Everything, Julie Newmar."
