LOS ANGELES, April 9 (UPI) -- Rick Bynes says his actress daughter Amanda had not been drinking before her arrest last week for suspicion of DUI in Los Angeles.

The "What a Girl Wants" and "Hairspray" star was arrested late Thursday after she allegedly scraped a police car she was trying to pass in her black BMW.

"She was not drunk," Rick Bynes told People.com Monday. "I was told that she blew a zero on the Breathalyzer. She didn't have a single drink that night. My daughter doesn't drink."

She was cited and released on her own recognizance a short time later, without having to post bail, he said.

The elder Bynes added the actress was arrested because "she was upset and very emotional."
