N.Y. judge throws out Kesha's claims against Dr. Luke

NEW YORK, April 7 (UPI) -- A New York judge has thrown out a majority of singer Kesha Rose Sebert's counterclaims against producer Dr. Luke in an ongoing lawsuit.

N.Y. Supreme Court Justice Shirley Kornreich said Wednesday the court's lacked jurisdiction while the pop star failed to present facts proving Lukasz "Dr. Luke" Gottwald alleged actions were discriminatory based on her gender, according to documents obtained by People.

Sebert's legal team, Kornreich stated, did not successfully prove Gottwald's alleged actions were motivated by hate. "Every rape is not a gender-motivated crime," the judge said, citing that as one of the reasons why most of her appeal to a February decision was dismissed.

The singer, who has not released new music in four years due to the ongoing lawsuit, maintains her position Gottwald had sexually, emotionally and physically abused her throughout their professional relationship.

The move comes shortly after Kesha announced Sony and Dr. Luke had offered to free her from her contract -- which binds her solely to the music producer -- with them if she retracted rape claims.

"I got offered my freedom IF i were to lie. I would have to APOLOGIZE publicly and say that I never got raped," the "Tik Tok" singer wrote on Instagram Sunday. "THIS IS WHAT HAPPENS behind closed doors. I will not take back the TRUTH. I would rather let the truth ruin my career than lie for a monster ever again."
