RIVERSIDE, Calif., Aug. 25 (UPI) -- U.S. actor and comedian Andy Dick has been charged with assault and drug possession stemming from a July arrest in California, prosecutors said Monday.

Riverside, Calif., District Attorney spokesman Ryan Hightower said, however, that sexual battery charges against Dick, 42, were dropped due to lack of evidence, People Magazine reported. The former "NewsRadio" cast member's arraignment has been set for Wednesday.

Hightower said Dick faces four misdemeanor counts of assault, possession of marijuana and Xanax without a prescription, and public intoxication, the magazine reported. Police said Dick was arrested July 16 outside a restaurant in Murrieta, Calif., after he allegedly walked up to a 17-year-old girl, grabbed her tank top and bra and pulled them down, exposing her breasts. Authorities said Dick appeared "extremely intoxicated."

People said Dick was cited last year in Columbus, Ohio, for urinating on a sidewalk and was arrested in 2004 for marijuana possession, although the case was dropped.

He was also charged in 1999 with driving while intoxicated and hit-and-run driving after colliding with a telephone pole in Los Angeles, for which he drew three years' probation and an order to undergo drug treatment, the magazine said.
