Anna Nicole Smith loses case against ex

LOS ANGELES, Dec. 22 (UPI) -- Anna Nicole Smith has been ordered by a Los Angeles judge to submit her three-month-old daughter to a DNA test.

Dannielynn Hope has been the center of a controversy since Smith's ex-boyfriend, freelance photographer Larry Birkhead, claimed that the child was his and not Howard K. Stern's, People magazine reported Thursday.

"If I was on anybody's Christmas list, they can scratch me off because this is the best Christmas present I could have ever received," Birkhead told People. "I'm one step closer to beginning a relationship with my daughter."

Superior Court Judge Robert A. Schnider said in his ruling that the parties involved with the case will have to decide where the tests will be done, whether it's the Bahamas or the United States.

Smith and Stern have been living in the Bahamas since she gave birth to Dannielyn there on Sept. 7, just three days before her son, Daniel, died in her hospital room.
