Brancato says statements were involuntary

NEW YORK, May 4 (UPI) -- Actor Lillo Brancato Jr. wants statements he made to police about the killing of an off-duty New York police officer suppressed.

Motions filed in New York Supreme Court by attorney Mel Sachs claim Brancato was in too much pain from gunshot wounds to waive his rights, so anything he said to police about the slaying of Daniel Enchautegui should be inadmissible in court, The New York Post reported Thursday.

"It is submitted that any purported admission made by Mr. Brancato, under the circumstances attentive to this case, was involuntarily made, and that any waiver of his rights were neither knowing nor intelligent," the attorney wrote.

Enchautegui managed to shoot Brancato twice in the stomach before dying. He had interrupted Brancato and another man as they allegedly broke into an apartment in search of prescription drugs last December.

Brancato appeared with Robert De Niro in "A Bronx Tale" and had a recurring role on HBO's "The Sopranos."
