Circumstances disputed in Proof death

DETROIT, April 14 (UPI) -- Attorneys for the late Detroit rapper, Proof, and the man who allegedly shot him are telling different stories about how Proof died.

Proof's attorney, David Gorosh, was quoted in the Detroit Free Press Friday denying his client fired the first shot at an after-hours club party early Tuesday morning.

"To indicate that Proof pulled the trigger first is reckless and quite frankly it will be proved to be untrue," Gorosh said.

Proof, a member of the rap group D12 and a close friend of Eminem, was dead at the scene.

Mario Etheridge, 28, was charged Friday with carrying a concealed weapon and discharging a firearm inside an occupied building, but not with murder, the Free Press said. His arraignment was scheduled for Saturday.

Etheridge's attorney, Randall Upshaw called the charges "ridiculous" and said Etheridge only fired after Proof shot his cousin, Keith Bender Jr., in the face.

Proof was shot three times as he stood over the fallen Bender and was preparing to fire off another round, police and Upshaw told the Free Press.

Bender remained hospitalized Friday in critical condition.
