Jason Patric sues for wrongful arrest

AUSTIN, Texas, Feb. 14 (UPI) -- Actor Jason Patric's lawsuit was amended Monday to drop the city of Austin, Texas, but continued against the police officer he claims wrongly arrested him.

Patric's suit, now just against officer Joshua Visi, claims excessive force and false imprisonment for his arrest in downtown Austin in March 2004, the American-Statesman reported.

Patric, 39, was arrested following a cast party for his film, "The Alamo," and charged with public intoxication and resisting arrest.

Patric's attorneys showed video shot from the patrol car of their client's arrest in an effort to prove there was no reason for the incident to have occurred, the newspaper said.

A police affidavit said Visi was trying to clear an intersection when Patric "assumed an aggressive stance." The actor reportedly told the officer to either give him breath test or take him to jail and ended up being wrestled to the ground, the newspaper said.

The charges against Patric were dropped after prosecutors deemed he did not resist arrest and there was no proof he was intoxicated.
