Murder suspect's mom arrested as accessory

MARTINTEZ, Calif., Oct. 28 (UPI) -- The mother of the 16-year-old charged with killing TV analyst Daniel Horowitz's wife in California has been arrested for accessory to murder.

Scott Edgar Dyleski did not enter a plea during his Thursday arraignment in Martinez, Calif., for first-degree murder and his attorney withdrew from the case, which caused further proceedings to be delayed until Nov. 9, CNN reported Friday.

Dyleski is being held on $1 million bail and will be tried in adult court.

His mother, Esther Fielding, is accused of calling her son and telling him their neighborhood was full of police the night Horowitz found his wife, Diane Vitale, beaten and stabbed at their Lafayette home just east of Oakland, Calif. The Dyleskis were neighbors.

Fielding allegedly told her son to spend the night at his girlfriend's house instead of coming home, an affidavit said.

District Attorney Bob Kochly declined to comment on the case and Contra Costa County Superior Judge David Flynn scheduled a hearing requesting a gag order for Nov. 10.

The case has received nationwide attention because Horowitz is a frequent contributor to TV news shows as a legal analyst.


Jackson benefit single recorded in L.A.

LOS ANGELES, Oct. 28 (UPI) -- A Los Angeles recording studio has been humming this week with work on Michael Jackson's benefit single for U.S. hurricane relief efforts.

The participants as well as the song remain a mystery, but Billboard.com said recording has been taking place at Conway Studios.

Jackson spokesman Raymone Baine said the pop star rewrote the song, originally announced as "From the Bottom of My Heart," and the new name as well as new theme will be announced in coming days.

Baine also said Jackson cut down the number of celebrities he originally planned to participate in the single, but he refused to name them as well.

Sources told Billboard.com Ciara, Snoop Dogg and Shirley Caesar were spotted at Conway.

Jackson, who is living in Bahrain and recently went to London to work on the track, is participating in the Los Angeles recording via satellite and telephone.

Jury will hear Spector's accounts of death

LOS ANGELES, Oct. 28 (UPI) -- The Los Angeles jury in "Wall of Sound" producer Phil Spector's trial will hear what he told police investigating the shooting death of Lana Clarkson.

A Los Angeles Superior Court judge Thursday refused a defense request to quash statements Spector made to investigators, including his claim the shooting was an accident, The Los Angeles Times reported Friday.

Later, Spector allegedly changed his story to the B-movie actress committed suicide on Feb. 3, 2003, at his Alahambra mansion.

Los Angeles Superior Court Larry P. Fidler ruled police were not formally interrogating Spector when he made the statements and he also rejected the defense claim Spector was "figuratively punched around until he said something," the Times said.

Fidler also said prosecutors may present Spector's 1975 conviction for brandishing a gun, if the defendant testifies.

Spector has pleaded not guilty to Clarkson's murder and is free on $1 million bail. He faces life in prison if convicted.

Spector's trial is supposed to start Jan. 30, but it could be delayed if his attorney gets hung up in a federal mob trial in New York, the Times said.


Lawsuit filed over Lenny Kravitz's toilet

NEW YORK, Oct. 28 (UPI) -- Rocker Lenny Kravitz is overflowing with court dates from a clogged toilet that sent water spilling into his New York neighbors' apartments.

A second lawsuit has been filed against Kravitz for the Aug. 1, 2004, bathroom mess, the New York Daily News reported Friday.

Allstate Insurance Co. filed the latest suit in Manhattan Supreme Court seeking reimbursement for $9,387.87 to Daniel Pelson, whose third-floor apartment was damaged by Kravitz's toilet water.

Kravitz was sued by another tenant for $300,000 in damages last year.
