Cooper Owen's John Collins told the BBC the seller purchased the items legitimately and denied the band members' claim the items were pilfered.

"No proof of theft has been offered," Collins said. "They have offered no evidence so we have no reason to stop the auction at the moment."

The Beach Boys' label, Brother Records Inc., released a statement saying U.S. police were investigating the theft and the FBI and Interpol may be called in as well.

Collins said the vendor who supplied the Beach Boys items bought them 25 years ago from a band associate who was "clearing out junk."

The Beach Boys items were to be part of a large auction Thursday including Beatles memorabilia as well.
