Questions arise in Sizemore/Fleiss beating

LOS ANGELES, Oct. 22 (UPI) -- A Los Angeles judge has given authorities a month to convince him not to toss out actor Tom Sizemore's conviction for beating Heidi Fleiss.

Sizemore contends pictures were faked, which led to his conviction of beating his former girlfriend, the notorious Hollywood madam, two years ago.

Fleiss' friend, Tara Dabrizzi, reportedly shot the photos of her friend's alleged injuries, but left the country the following day and did not testify against Sizemore during his trial. His attorneys have questioned whether the woman even actually exists, the Los Angeles Times reported Saturday.

Sizemore's attorneys say they have witnesses who will testify Fleiss did not have bruises or injuries on her face when they saw her around the time the photos were taken.

The actor's legal team said Superior Court Judge Antonio Barreto Jr. has given prosecutors 30 days to find the woman or prove the photos were not doctored. However, his action only applies to the battery count against Sizemore -- not his other conviction for threatening and making obscene phone calls to Fleiss, the Times said.
