Michael Jackson accuser won't be tested

SANTA MARIA, Calif., Nov. 30 (UPI) -- Michael Jackson's lawyers will have to defend their client against molestation charges without psychological tests on the accuser.

A Santa Barbara County Superior Court judge Monday denied a defense request for examinations of the 12-year-old accuser, his mother and siblings, the Los Angeles Times reported Tuesday.

The pop icon, scheduled for trial Jan. 31, is accused of molesting the boy and conspiring to cover it up.

Prosecutor Ron Zonen criticized the defense effort as a fishing expedition calculated to cast the mother as a chronic liar and emotionally unstable.

"They are simply not entitled to the gynecological records of the victim's sister, or mother," Zonen said. "That constitutes harassment."

In court papers, defense lawyers have claimed such records could be relevant because they might point to drug use.
