Eminem sues Apple, MTV for song's use

DETROIT, Feb. 24 (UPI) -- Detroit rapper Eminem is suing Apple Computers and MTV for copyright infringement over an Apple iTunes TV commercial featuring "Lose Yourself."

The lawsuit, filed in U.S. District Court in Detroit, says Eminem's publisher, Eight Mile Style, never gave permission for the use of the song in ads that began airing in July 2003 on MTV, the Detroit News reported Tuesday.

The ad for Apple's Internet store, with a 10-year-old boy singing Eminem's tune, ran for at least three months on MTV and appeared on Apple's Web site.

"Eminem has never nationally endorsed any commercial products and ... even if he were interested in endorsing a product, any endorsement deal would require a significant amount of money, possibly in excess of $10 million," the 15-page lawsuit said.

The song wasn't copyrighted until Oct. 27, 2003, according to a registration certificate filed with the U.S. Copyright Office.
