Judge dismisses Paul Allen lawsuit

SEATTLE, Dec. 13 (UPI) -- Attorneys for Microsoft co-founder Paul Allen said they would refile a patent case against several U.S. technical giants tossed out of court Monday.

Allen's attorney's called the dismissal of a case against Google, YouTube, Apple, Facebook, Yahoo, AOL and several other technical firms a "procedural issue," that did not address the merits of the case, The Philadelphia Inquirer reported.

The case involves four patents Allen claims were developed at Interval Research, a start-up Allen helped finance that was shuttered 10 years ago.

U.S. District Judge Marsha Pechman agreed with defendants Google and AOL, which filed papers saying the case did not name the products that had benefited from the alleged infringement.
