WILMINGTON, Del., Aug. 10 (UPI) -- A Delaware judge gave a highly qualified pass to Walt Disney Co.'s outgoing chief executive for paying a fired executive $140 million.

Chancellor William B. Chandler III of Delaware Chancery Court ruled that Michael Eisner was within his rights to pay the huge sum to Michael S. Ovitz, whom he hired and then fired in 1995 as Disney's president, the New York Times reported Wednesday.

However, Chandler leveled a blistering attack on Eisner's judgment Tuesday, calling him a "Machiavellian" schemer who "enthroned himself as the omnipotent and infallible monarch of his personal Magic Kingdom."

The decision, hailed by Eisner's lawyer, will be appealed by the plaintiffs.
