He was previously arrested for stealing a car and taking a radio from a parked car.

Toone, 30, was released from the Westchester County Penitentiary about 30 miles from Yonkers last March after serving five months for violating terms of his probation.

According to police reports, Toone attempted to break into the car July 31 but fled when the car's alarm system went off. He was later arrested on a city bus.

Toone, who never received his undergraduate degree, played four seasons for Marquette, the last in 1978-79. He was picked in the second round of the NBA draft by Philadelphia and played in 23 games his rookie year. He was cut by the 76ers the following year and played on various European teams for four years.
